Terms and Conditions
By using Pincelada you agree to these terms. Pincelada is operated from Uruguay and connects independent artists with buyers of original art.

1. About Pincelada
Pincelada is a marketplace that connects independent visual artists from Uruguay with buyers. Pincelada is not a party to the transaction between artist and buyer — it acts as a technology intermediary facilitating the commission, payment, and delivery process. Pincelada does not own, produce, or store artworks.
2. Accounts and registration
To use the platform you need to create an account with a valid email and password. You are responsible for maintaining the security of your account. Artists must complete an identity verification process before they can sell. Pincelada reserves the right to suspend or delete accounts that violate these terms.
3. Custom commissions
The buyer describes what they want, and the artist submits a quote with price and estimated timeline. If the buyer accepts, they pay a 50% deposit of the total price (plus a 5% service fee). The artist works on the piece and upon completion the buyer pays the remaining 50%. The final payment is held until the buyer confirms satisfactory delivery of the artwork.
4. Direct artwork purchases
Artworks listed with a price can be purchased directly. Payment is made in a single step for the full price plus the 5% service fee. The artist coordinates delivery with the buyer after confirming payment.
5. Exhibitions (auctions)
Artists may list artworks in timed exhibitions where buyers submit bids. At the end of the exhibition, the highest bidder wins and is obligated to complete the purchase at the winning price plus the 5% service fee. Payment must be completed within 48 hours of the exhibition closing; failure to pay may result in account suspension and the artwork being offered to the next highest bidder. Artists may set a reserve price below which no sale is made. The same fees apply as for direct sales: 5% buyer surcharge and 8% artist commission.
6. Payments and fees
All payments are processed through MercadoPago. Pincelada charges a 5% service fee to the buyer on the quoted price, and an 8% commission to the artist on each payment received. MercadoPago processing costs are borne by the artist. Prices are expressed in Uruguayan pesos (UYU). Pincelada does not store credit card data.
7. Cancellations and refunds
A commission can be cancelled at no cost before the artist has begun work. Once the artwork is underway, the deposit is non-refundable unless the artist fails to deliver as agreed. If there is a problem with delivery or artwork quality, the buyer may open a dispute and the Pincelada team will mediate to find a fair resolution, which may include a partial or full refund.
8. Content and intellectual property
Artists retain intellectual property rights over their works. By publishing on Pincelada, they grant a non-exclusive license to display images on the platform for promotional and sales purposes. Publishing unauthorized reproductions, undisclosed AI-generated art, or content that violates third-party copyright is not permitted.
9. Disputes
If a conflict arises between buyer and artist, either party may open a dispute from the platform. The Pincelada team will review the case and mediate to reach a fair resolution. Pincelada reserves the final decision on refunds in dispute cases.
10. Prohibited conduct
The following are not permitted: sharing contact information to circumvent the platform during an active transaction, creating fake accounts, manipulating reviews, harassing other users, or using the platform for illegal purposes. Violations may result in permanent account suspension.
11. Limitation of liability
Pincelada facilitates the connection between artists and buyers but does not guarantee the quality, timeliness, or outcome of any commission. Pincelada's liability is limited to the amount of fees charged for the transaction in question. Pincelada is not liable for indirect damages.
12. Modifications
Pincelada may update these terms at any time. Changes will be communicated by email to registered users and published on this page with the date of last update. Continued use of the platform implies acceptance of the updated terms.
